Only if the cop had his gun suspended in mid air over his head.  That takes 
some good telekinesis to do that plus all the normal stuff a cop would do.  I’m 
sure a few of those protesting maybe think cops are members of an occult group, 
but they think a lot of things without any proof.  

So yes, his hands weren’t up if he was trying for the cop’s gun.  But they want 
two sets of rules.
