No 1.....Lawyers will not bother with a $75 recovery. No money in it for
them.

No 2....Was check stopped or NSF.


No 3....This is a scam. True he could have done the same with a Credit
Card, but Credit Card companies keep track of this type of stuff.


Remedy....I get calls from Collection Agencies every 2 or 3 months,
asking me if I have any bad debts to collect. They normally get 20 to
25% of the total. In this case I would submit it, expecting "nothing" in
return, just for the principle of the thing. These people will hound him
on a regular basis, and if nothing comes of it, will submit it to the
Credit Bureau.

        Stop Payment on a check, is a nice way to scam businesses, but
if he has not given you a chance to ratify the problem...(if there even
is a problem), then you are giving him the indication that this is a
good way to get Goods and Service. Let hi try that with the Gas Company,
because the gas has a funny smell, they would just cut off the Service,
so he would not have to smell it anymore.

        Give the account to a collection agency, and my guess is, after
the first phone call from them....he will be in to see you.

        Forget about Small Claims court, more time wasted, and he may
not even show up, you will have the judgment, but still no money.


Do us all a favor, and go after the SOB. This may just be another way to
subsidize his Income, if he has any.

        Writing a Check is a promissory agreement with the seller and
buyer that Goods and Service will be covered. He defaulted on his part,
the same as if you had given him 30 days guarantee on your Service and
had not followed up.

Sic him....Make his life a living hell.;-)

i had an experience i didnt know how to solve.
i repaired a tv, customer picked up and paid 75 with check.
10 days later i get a letter from my bank saying they withdrew 
the 75 from my account because the check was stop payment.
i called the customer and would always be told the man wasnt home,
finally i did talk to him a week later.
he said he stooped payment because he didnt think it was good 
enough picture.
i said why didnt you call me , or bring it back , so i could 
make it right.
at least let me have my parts back.
he said no.
and that i should take him to court for the 75 if i like. and 
hung up.
i contacted my attorney, who said forget it , you been screwed.
the set probably works fine and he knows you cant afford to 
sue him.
and since then i found that he could have also stooped payment 
on a credit card if he had used one.
are there any answers to this type of problem???
