If you have not already done so you should notify your insurers. It is very
likely there will be a claim for personal injuries. Get those directly
involved to write reports on the incident as soon as possible and to sign
and date them.
Insurers generally just take over and deal with the family.
I'm a solicitor by profession but don't always admit to it!

Hmmmm................this twangs a raw nerve as we recently had an accident
on our club track. The track is elevated 5" gauge and we were running trucks
with no seals between the ends. The risk assessment said the gap was too
large to trap a hand and too small to allow a foot to enter. There were
reasons why we had not yet fitted seals.
What appears to have happened is that a father sat at the front end of a
truck and held his young daughter between his legs with her legs dangling
between the trucks. At the first bend one of the poor girls legs became
trapped. The driver stopped immediately and the girl was quickly released.
The parents then ran off with the child cursing at any club member they
passed. They went to the medical tent at the Steam Fair being held in an
adjacent field and an ambulance was called.
The accident had a most sobering effect on all the members present, we
stopped all running and ket all members of the public out of the site. Then
we heard that the police had been called. The police duly arrived, looked at
the set up and declared it to be "an accident", of no further interest to
them. They advised us to contact HSE and we prepared ourselves to for the
RIDDOR process.
Our secretary spent a sleepless Sunday night before he phoned to HSE on
Monday morning. They already had a report from the police and took more
details over the phone. During that afternoon the HSE phoned the secretary
to say they were satisfied that we had reacted appropriately to the accident
and they intended to take no action.
The situation with the little girl is less clear as we have been strongly
advised from all quarters not to contact the family and they have yet to
contact the club.
