May be you should go to Hp or Dell outlet and demand a Netbook
without XP ( or vista or win7) and ask for a refund or discount .
We will be grateful if you post your experience or the replies you got
from the vendors.
Then collectively we may be able to do something about it. May be look
into legalities and take them to task.
