ato is definitely a creditor, but they'll only recover the tax. not sure =
how that will affect you if you've been paid and the tax from that =
wasn't paid to ato.

we bundled together and APESMA said they would be happy to take on our =
case if we all joined (some were already members) - they were assessing =
exactly how happy they would be when our ex-company refinanced and upped =
the timetable. we hadn't all joined by that point, but would have if =
they'd committed to setting their legal dept onto our case. so if there =
are enough of you, you might be able to gang up for support.

ganging up is definitely worthwhile, and making sure you keep up a good =
line of communication so everyone know's what's going on, and also to =
have one point of contact with the people whose time you don't want to =
waste (ie the ones who actually get back to you with useful info).

who is the adminstrator/liquidator?

Whoa, nasty! Obvious first points of contact would be the Australian
Taxation Office re. the unpaid tax and super - maybe they have some sort =
of
authority to attempt to recover the funds as a creditor? Dept of =
Employment,
Workplace Relations & Small Business might be another good source of =
help.
(On the other hand, this is the government - so she may waste an =
afternoon
talking to a pack of tossers who want to leave this in the Too Hard =
Basket -
hopefully not!).
What else? Assume she's not a union member, and obviously it's a bit =
late to
join one now - there may be people in one of the big unions who have the
legal nous to advise her on her rights though. And last but not least - =
any
well known ambulance chasers up there? I hesistate to recommend placing
oneself in the clutches of a no-win, no-fee legal firm, but she may be =
able
to glean some useful advice at the preliminary interview (then nick off
without signing her soul away!).

HTH, regards Andrea

The company in which one of our fellow Technical Writers worked has just
been closed.
She has received no termination payment, final pay, holiday pay and =
recent
superannuation and tax weren't paid. She was a full time permanent =
employee
for the past 14 years.

Does anyone have any useful advice or sources of assistance that she can =
use
to help get any money from the wash-up of this company?=20

I'm sorry to say that the ASTC(NSW) isn't able to help in this instance.

Thanks in advance.....

(I shall print and hand over any replies to her.)
