I think even executive orders have limits.  First of all they actually can be 
over turned if congress would ever have the balls to do it.  But it would be 
very hard to justify so even law enforcement agencies could proceed against 
that let alone the military.  Just because a President says something doesn’t 
quite make it absolute.  Now it going to Supreme court, that could be dicey.  
Remember they seemed to have no problem with Obama care being constitutional, 
and some other interesting things they seem to go along with over the past 
couple of years are rather ominous.  Maybe Obama wouldn’t mind at all if it 
went to Supreme court, they would probably just rubber stamp it along.
