Peter, I knew posting that message would bring about questions not 
easily answered.  But the questions must be asked and must be answered.  
It will come out sooner or later.  It is probably not a popular position 
to hold - but my gut feeling is, yes out of staters are more likely to 
sue.  Mainly because they are least familiar with desert terrain and apt 
to make an unfortunate decision like getting lost in the desert, making 
a wrong turn or not having proper clothing and catching a bad cold.  Not 
to say something like this can happen to someone who lives in Arizona.

As far as who signs waivers?  Everyone who shows up at the marathon 
site.  This means not only those participating in the marathon, but also 
those that have their own observing list, astro-photographers and folks 
along for the ride.  Don't think this should apply to Ray Farnsworth and 
his family.  Parents will have to put their children's name on the 
waiver.  They are responsible for them and their behavior.
