It is the policy of The Washington Post not to publish anonymous
pieces. In this case, an exception has been made because the author
-- who would have preferred to be named -- is legally prohibited from
disclosing his or her identity in connection with receipt of a
national security letter. The Post confirmed the legitimacy of this
submission by verifying it with the author's attorney and by
reviewing publicly available court documents.
The Justice Department's inspector general revealed on March 9 that
the FBI has been systematically abusing one of the most controversial
provisions of the USA Patriot Act: the expanded power to issue
"national security letters." It no doubt surprised most Americans to
learn that between 2003 and 2005 the FBI issued more than 140,000
specific demands under this provision -- demands issued without a
showing of probable cause or prior judicial approval -- to obtain
potentially sensitive information about U.S. citizens and residents.
It did not, however, come as any surprise to me.
Three years ago, I received a national security letter (NSL) in my
capacity as the president of a small Internet access and consulting
business. The letter ordered me to provide sensitive information
about one of my clients. There was no indication that a judge had
reviewed or approved the letter, and it turned out that none had. The
letter came with a gag provision that prohibited me from telling
anyone, including my client, that the FBI was seeking this
information. Based on the context of the demand -- a context that the
FBI still won't let me discuss publicly -- I suspected that the FBI
was abusing its power and that the letter sought information to which
the FBI was not entitled.

Oracle announced Thursday that it has filed a lawsuit against archrival
SAP, alleging the software giant hacked into Oracle's customer support
center and downloaded copies of its proprietary software code.
The lawsuit, filed in the U.S. Federal District Court for Northern
California, names SAP and its wholly owned subsidiary TomorrowNow as
defendants. Among its claims, the lawsuit [1] (PDF) alleges SAP and
TomorrowNow engaged in computer fraud and abuse, computer data access
and fraud, and intentional interference with prospective economic
advantage.
"This systematic theft of Oracle's software and support materials did
not originate from any actual customer location. Rather, the access
originated from an Internet protocol (IP) address in Bryan, Texas, an
SAP America branch office location and home of its wholly owned
subsidiary SAP TN," the lawsuit alleges.
TomorrowNow, which SAP acquired in 2005, offers support and maintenance
to PeopleSoft and J.D. Edwards customers. SAP and TomorrowNow launched a
major marketing campaign to woo away customers, shortly after Oracle
acquired its former rivals PeopleSoft and J.D. Edwards in 2005.

Digital Library for Math and Science Resources

I would like to share a digital library project-AMSER- with all of
you. AMSER (the Applied Math and Science Education Repository) is a
portal of educational resources and services built specifically for
use by those in Community and Technical Colleges but free for anyone
to use. AMSER is a non-profit organization and is funded by the
National Science Foundation (NSF) as part of the National Science
Digital Library (NSDL). We are a fairly new project, and are
constantly adding new resources to our library. (About 200-300 per
week) The resources we add to our site come from other online digital
collections, staff (area expert) additions, as well as from faculty
from around the country. The goal of AMSER is not only to provide a
site where instructors and students can find high-quality and
authoritative web resources but to provide tools to use these
resources as well. We provide a folder system (which allows you to
share resources online), bulletin service (to update you with subject
specific resources), saved searches, rating and comments systems and
more. Because we are new, we would appreciate any feedback for
improvements that could be made to the site to make it more useful for
you, as well as any suggestions for online material that we could add.

but are not kept up to date via error corrections, format changes,
and many other improvements. . .not to mention that you can choose

NPR Leads Legal Battle Against Increased Online Royalties

Radio (NPR) has filed for a rehearing with the Copyright Royalty Board (CRB)
over the proposed increase in Internet radio royalty rates. In a
statement, NPR
VP for Communications Andi Sporkin said, "This action is the first step in
NPR's efforts to reverse the decision, and it will be followed by an appeal of
the Board's decision to be filed with the U.S. Court of Appeals for the D.C.
Circuit. The Board's decision to dramatically raise public radio stations'
rates was based on inaccurate assumptions and lack of understanding of the
issues. The new rates inexplicably break with the longstanding tradition of
recognizing public radio's non-commercial, non-profit role, while the
procedures
we're being asked to now undertake for measurement are non-existent,
arbitrary and costly."

A former White House official accused of improperly editing reports on
global warming defended his editing changes Monday, saying they
reflected views in a 2001 report by the National Academy of Sciences.
House Democrats said the 181 changes made in three climate reports
reflected a consistent attempt to emphasize the uncertainties
surrounding the science of climate change and undercut the broad
conclusions that man-made emissions are warming the earth.
Philip Cooney, former chief of staff at the White House Council on
Environmental Quality, acknowledged at a House hearing that some of
the changes he made were "to align these communications with the
administration's stated policy" on climate change.
The extent of Cooney's editing of government climate reports first
surfaced in 2005. Shortly thereafter, Cooney, a former oil industry
lobbyist, left the White House to work at Exxon Mobil Corp.
