As we were taught on my law course, evidence is vital. Good to see you on this list Ben, last time I came across you and your comments was on the Dolphinusers list.

So, if I understand correctly, someone sold someone a phone with talks
on it. The buyer then disided to upgrade that talks installation which
surely is hers since it was left on the phone that she now owns. Now,
due to what seems to be a stupid oversight from the seller, the seller
can not upgrade there installation of talks.

Seems like the sellers completely in the wrong here; they should have
stipulated to the buyer some terms on which the phone would be sold to
them or spoken to comproom to advise that the phone had been sold and
not to onner any upgrades from that phone.

Goodness me, why on earth do some blind people take things completely
out of proportion? Legal action against someone who seems pretty
adament that they've never had deelings with the other party? wow.

I'm off now, I have better things to do than argu over petty issues like this.

  Bridie

As the moderator has requested we don't deal with this on the list, I
think we should respect that. I just want to make two points. After that
please address any further Emails to me and I assure you I will deal with
them.

Firstly, I have never bought from or sold a phone to you.

Secondly, if I am supposed to have stolen your upgrade, why didn't you get
in touch with me or report me to Nuance?

I won't comment any further on this list.

                  To The Moderator

Find below an email that was posted but didn’t make it to
the list from Bridie who is the person I referred to in my posts.

When she was wrongly made to pay £150 because her licence
had been taken over without her or nuance’s permission, she was totally
dumbfounded and had no option but to pay to carry on using talks on her new
phone.

I think Bridie has explained the matter quite plainly in
her email.

To be fair I feel that as Barbara Wilson requests that any
other contact be to her personally I feel that it will be swept under the
carpet and that is why perhaps Bridie's email should have been posted to at least allow other people to form their own opinion on the Licence Agreement.

Barabara regarding the emails from Barry Hughes I am the
person he is referring to. I sold you a Nokia e50 which was imediately
upgraded without either mine or Nuances permission. When I needed to upgrade
on my licence it then came to light that it had been hijacked from that
Phone leaving me having to pay the full Licence amount of £150. After
months of hassle and me finally threatning Legal Action this matter has
recently been resolved throuhg Computer room services and I have been
refunded the £100 with Nuances permission.

Perhaps this situation would and should not have
occurred if people adhered to the Licence Agreement.
