Andrew, here is why I was so sure that CRS is free, even without having
all the documents: I have had a conversation about it last year with a
guy who is relatively high in the chain of command and who told me that
they are looking to push into the clustering market and kill RH Cluster
and Veritas Cluster. Those are fail-over clusters and that is why it is
free and why Oracle made it work with Postgres and MySQL.
However, that was a private conversation and I cannot prove anything.
However, I know it is free and I know the motivation.

I think the reason why we have these conversations is that far too often Oracle licensing is anything but transparent. I really appreciate Mladens information, and I expect I will do some experimentation with Oracle clusterware and Postgres, but we already have at least two, and possible three different opinions on oracle clusterware licensing. Of course, afaik none of us are lawyers, but just the fact that have this conversation, and so many different opinions makes it clear (at least to me) that Oracle has serious problems with clarity on licensing.

There are only two ways to officially acquire the software that
you claim to be free.
From the OTN/Technet downloads page or from internal SW delivery
from Oracle which would require a SW/support agreement.
For the base SW which includes GRID control you are always pointed
to the OTN page even if you purchased SW.
If you use the OTN page then you have to say yes to the OTN
license agreement.
You must accept theOTN License Agreementto download this software.
AcceptLicense Agreement|DeclineLicense Agreement
If you click decline you are not allowed to download SW.
If you read the agreement from the link
http://www.oracle.com/technetwork/licenses/standard-license-152015.html
…”Oracle grants You a nonexclusive, nontransferable, limited
license to internally use the Programs, subject to the
restrictions stated in this Agreement, only for the purpose of
developing, testing, prototyping, and demonstrating Your
application and only as long as Your application has not been used
for any data processing, business, commercial, or production
purposes, and not for any other purpose.…”
You can only use it for “developing, testing, prototyping, and
demonstrating“ you cannot use it for “for any data processing,
business, commercial, or production purposes, and not for any
other purpose“.
It doesn’t matter whether the SW is free in the end or not, you
are not allowed to use it for real every day purposes. This is
what you legally agreed to be bound by.
Only by having a SW Purchase agreement and/or Support agreement
are you allowed to use the software for those restricted
activities listed in the OTN agreement.
“…If You want to use the Programs or Your application for any
purpose other than as expressly permitted under this Agreement,
You must obtain from Oracle or an Oracle reseller a valid Programs
license under a separate agreement permitting such use.…”

Oracle Clusterware Oracle Clusterware can be installed and used to
protect any Oracle or third-party software provided any of the
following conditions are met:
1. The software being protected is from Oracle.
2. The software being protected uses an Oracle Database.
3. The software being protected is running on Oracle Unbreakable
Linux.
4. The software being protected is running in a cluster where at
least one machine involved in the cluster is licensed using the
appropriate metric for either Oracle Database Enterprise Edition
or Oracle Database Standard Edition.
A cluster is defined to include all the machines that share the
same Oracle Cluster Registry (OCR) and Voting Disk.

As an Oracle Linux Support customer, how do I obtain Oracle
Clusterware?
Oracle Linux Support customers at the Basic and Premier levels can
download the product and deploy it for free as part of their
Oracle Linux Support contract.
For 11gR2 and 12c, the wording changed which is where I think you
are getting confused Mladen, but you still have to get to download
it by agreeing to the OTN License policy which limits your use
meaning free does not mean free for anything you can think of
doing with the SW.

Oracle Clusterware Oracle Clusterware provides cluster membership
and high availability monitoring and failover. Oracle Clusterware
may be used to protect any application (restarting or failing over
the application in the event of a failure) on any server, free of
charge. Oracle will provide support for Clusterware only if the
server is running an Oracle product, which may include Oracle
Linux or Oracle Solaris, that is also under Oracle support.

Hi Hemant!
Of course support requires a licensed product. We weren't talking
about support. We were talking about the clusterware. And
clusterware is free. Thanks for finding more quotes confirming my
claim.
