Somehow I think the nations who would be peeved about flying military
transports airplanes overhead might *also* be peeved about flying military
transport ICBMs overhead.
However, the legal situation is different: they are legitimately entitled
to bar transport airplanes from their airspace, but right of overflight
through space, even for military purposes, is well established. Trying to
push your way through their airspace regardless is certainly a violation
of neutrality and probably an act of war, while orbiting overhead is
neither. (And on the pragmatic side, most nations are equipped to dispute
passage through their airspace, while the hardware needed to interfere
with spaceflight is a lot less common.)
