Evan,
I would not count that as the typical readily identifiable situation of
someone fraudulently presenting with a dog as service dog.
In the affluent, bustling urban area where I live, 9 times out of 10 that I
see a dog in a restricted access place, it is not a genuine service dog.
And 99% of the time, I can tell. So would a professional trainer/handler or
someone with a well trained service dog or someone in the industry.
Most of the people bringing these dogs places do not know that a zillion
things the dog or they do give them away. And most seem very surprised by
challenges that their dogs end up facing the dogs fail at. Probably most
commonly, for us, we encounter little dogs that go absolutely ape & freak
out upon seeing/smelling/hearing the mere presence of my large service dog
entering the establishment.
Many people who have pets who serve as therapy dogs (or trained to) or
otherwise well behaved dogs in MOST normal pet contexts seem also to be
genuinely surprised when their dogs also do not do well in service dog
contexts.
Most people -- and, Evan, that means most people not married to an attorney
or in the industry -- also do not know the proper lingo or laws involved if
they were to be questioned properly by the business. Businesses would do
well to question them, properly, and to learn to more readily spot
questionable cases.
My point is, the VAST majority of the time, reflecting much of what the
public is realistically upset about, these situations need not be occurring
and being permitted by the businesses. I have worked with many businesses
to reduce the problems they encounter.
