I agree with all you say however anybody can read the suit and form their
own opinion. I think if they read it they will understand it better and
get a good idea of what the court decision will be. If they don't have a copy
of it, they can look at it on the Broward County website. It is public
information.

A Reservation-of-Rights letter simply allows an insurer to keep its

open. It also gives the insurer more time to investigate a claim and/or
gather more facts through discovery. A Reservation-of-Rights letter does
NOT presume a decision in ongoing litigation; thankfully, that
is"reserved"
for the court.
This case against the GSDCA has not yet gone before a judge; only the
matter of jurisdiction has been heard and even that is not settled. The
actual
merits, (or LACK THEREOF), have not yet been heard. A suit can allege
anything the plaintiff chooses; the declaration of those allegations
certainly
does not make them valid or true.
This case could drag on for many years to come. Inflammatory or
misleading
comments do not serve anyone involved, including and especially the
members of the GSDCA!

I have been asked to explain what "reservation of rights" means.
It has to do with the law suit against the parent club. The insurance
company is required to provide a defense, but if they find that the acts
complained of are intentional, and not neglegent, then the carrier does
not have
to pay for any damages, and may even ask for repayment of the expenses
paid
to that time. Few insurance companies will insure against intentional
acts.
Insurance companies often do that if they think there might be
intentional
acts causing the damages. It is often used in battery or asault cases. I
often have to fight the carriers over it, and it is an issue that is
determined in the courts.
It is a normal tactic of the insurance companies to encourage settlement,
and is a touchy issue since it puts your own carrier in conflict with the
insurred.
