One shouldn't assume that everyone posting to this list is aware of
the laws covering migratory birds.
In that regard; a reminder that in 1972, an amendment was made to the
MBTA (Migratory Bird Treaty Act) that protected an additional 32
families of birds, including eagles, hawks, owls, and corvids (crows,
jays, and magpies). Although 'incidental take' is in litigation right
now, there has been no change proposed for direct take prohibitions.
So when someone says "take action", I will remind everyone that that
action cannot include lethal action (unless a permit is obtained of
course, and no permit will ever be issued for the take of a hawk at a
backyard feeder)…..I hope.
