Ken Lay’s death means he is presumed innocent since the case was in appeal.   
The legal situation is as if he were never charged with crimes.  Civil suits 
against his estate (the Bush administration never had a civil case against him) 
can continue—but there can be no punitive penalties since Ken Lay dies an 
innocent.

 

Arnold Schwartzenager let the air tight seven billion dollar lawsuit that Gray 
Davis had implemented against Enron drop.

 

Bottom line:  Ken Lay dies innocent.  And No California recourse against Enron.
