NDA is irrelevant. The facts are: ISA2K4 Public Beta was neither designed for nor tested on SBS2K3. You can install anything you want on any platform you think you can install it on, the response is the same; if you didn't choose the platforms stated in the online docs and those that came with the product, you're unsupported. They are waiting on the release of ISA 2004 before they could do anything anyway. Although if I were on the beta of ISA 2004 I could not due to the NDA tell you if in fact it was or was not working with SBS2003. SBS2003 users got a new version of everything except ISA when they upgraded from SBS2000 to SBS2003. Or will this be used as the reason to get SBS users to upgrade again? Since most small companies have only the vaguest idea when ISA is, I don't think that they will go for that idea.
