In Texas we often include the following in our Participation Agreements:
USE OF LEGAL INTERNS AND LAWYERS AS OBSERVERS

The parties agree that legal interns and other lawyers may observe one or
more joint sessions in this collaborative law process, provided the
observers agree to sign a written observation agreement preserving the
confidentiality of any such observed session. The observer will not
participate in the joint sessions except as an observer. Such observing
shall be at no charge to the parties.

In the context of a mentoring process, could there be permission for new
practitioners to observe collaborative law sessions? This is done commonly
with the clients' permission in mediation training. The client understands
that the observor is there to observe the lawyers, not the parties, as such.
