The answer is for authors to ensure when handing over copyright that
there is a clause in the contract stipulating what happens if the

That may be *an* answer. My book contracts contained such conditions, hence
I can now make 'free' copies available. [1] So authors should ask about
this before agreeing to sign up with a publisher.
But for many authors the choice is being told by publishers, "Our way or
the highway". Similar situation for musicians quite often.
So I'd prefer something about this to be written into law. As it stands,
many authors, musicians, etc, may have works long unavailable and can't
find out who owns the rights. So can (legally) gain nothing from them in
terms of income or reputation.
Anyway, this is OT so I'll stop before someone objects... :-)

[1] Snag being that it may be that the publishers 'ate' the final version
of the MS or proofs, etc. I was lucky my second book was written with
!TechWriter, so generating a free pdf was simple. Not so for my first book.
Currently laboriously 'reconstructing' this from old 'view' files and scans
of ink-on-film diagrams and retyping all the equations!
