Article II, Section 1, Clause 1:
The executive Power shall be vested in a President of the United States of
America. He shall hold his Office during the Term of four Years, and,
together with the Vice President, chosen for the same Term, be elected, as
follows
Formerly, the term of four years during which the President shall hold
office was reckoned from March 4 of the alternate odd years beginning with
1789. This came about from the circumstance that under the act of September
13, 1788, of the Old Congress, the first Wednesday in March, which was
March 4, 1789, was fixed as the time for commencing proceedings under the
Constitution. Although as a matter of fact Washington was not inaugurated
until April 30 of that year, by an act approved March 1, 1792, it was
provided that the presidential term should be reckoned from the fourth day
of March next succeeding the date of election. And so things stood until
the adoption of the Twentieth Amendment, by which the terms of President
and Vice-President end at noon on the 20th of January.
The prevailing sentiment of the Philadelphia Convention favored the
indefinite eligibility of the President. It was Jefferson who raised the
objection that indefinite eligibility would in fact be for life and
degenerate into an inheritance. Prior to 1940, the idea that no President
should hold office for more than two terms was generally thought to be a
fixed tradition, although some quibbles had been raised as to the meaning
of the word term. The voters’ departure from the tradition in electing
President Franklin D. Roosevelt to third and fourth terms led to the
proposal by Congress on March 24, 1947, of an amendment to the Constitution
to embody the tradition in the Constitutional Document. The proposal became
a part of the Constitution on February 27, 1951, in consequence of its
adoption by the necessary thirty-sixth state, which was Minnesota.
Article II, Section 1 establishes that the president has the power to run
the executive branch of the government. This section, later modified by
Amendments XII and XXV, outlines who is eligible to serve as president,
establishes the Electoral College (the means by which the president and
vice president are elected), and authorizes Congress to determine who will
replace the president and vice president should they be unable to serve
during their term of office.
Article II, Section 1 establishes that the president and vice president are
to be elected at the same time and serve the same four-year term. *Until
1951, presidents could serve for as many four-year terms as they could win.
But after President Franklin D. Roosevelt was elected for four terms,
Congress passed and the states ratified Amendment XXII, which limits a
president to two terms (eight years) in office.* This IS unlawful since
they were De facto since after Lincoln's treasonous stay in office In the
rare case that a vice president (or other official) takes over for a
president who has stepped down or died in office and serves more than two
years of the remaining term, he or she is limited to one new term.
Rather than being elected directly by the people, the president is elected
by members of the Electoral College, which is created by Article II,
Section 1. It is not really a “college,” but a group of people who are
elected by the states. Each state is entitled to the number of electors
equal to the combined number of their representatives and senators in
Congress.
Neither members of Congress nor other federal officials may serve as
electors. Each state legislature decides how members of the Electoral
College are to be selected and how they are to vote. For example, some
states select electors at primary elections or at caucuses. In most states,
electors vote for the presidential candidate who won the vote in their
state. The two exceptions are Maine and Nebraska, where a candidate wins
one electoral vote for each congressional district that he or she wins and
two electoral votes if he or she wins the overall popular vote in the
state.The creation of the Electoral College gives more power to the smaller
states, rather than letting the people in the most populous states control
who becomes president.
Additional rules were added in 1804, when Amendment XII was adopted. For
example, the amendment creates the way a president is selected when neither
candidate obtains a majority of votes in the Electoral College.
There are three minimum requirements to be elected president: one must be a
natural-born citizen of the United States, must have lived in the United
States for at least 14 years, and must be at least 35 years old.
Although Article II, Section 1 originally provided who should become
president if the president dies, resigns, or is removed from office,
Amendment XXV, added in 1967, modified the line of succession.
The president’s salary is set by Congress. To avoid allowing Congress to
punish or reward the president while he or she is in office, the
Constitution prohibits any change in salary during the president’s term.
The president also is prohibited from receiving any other type of
compensation or perks while in office.
Before assuming office, the president must swear or affirm to do his or her
best to serve as the nation’s leader and to uphold the United States
Constitution as the law of the land.
*As for the Oath of Office*
Article II, Section 1, Clause 8:
Before he enter on the Execution of his Office, he shall take the following
Oath or Affirmation:–I do solemnly swear (or affirm) that I will faithfully
execute the Office of President of the United States, and will to the best
of my Ability, preserve, protect and defend the Constitution of the United
States.
What is the time relationship between a President’s assumption of office
and his taking the oath? Apparently, the former comes first, this answer
appearing to be the assumption of the language of the clause. The Second
Congress assumed that President Washington took office on March 4, 1789,
although he did not take the oath until the following April 30.
That the oath the President is required to take might be considered to add
anything to the powers of the President, because of his obligation to preserve,
protect and defend the Constitution, might appear to be rather a fanciful
idea. But in President Jackson’s message announcing his veto of the act
renewing the Bank of the United States there is language which suggests
that the President has the right to refuse to enforce both statutes and
judicial decisions based on his own independent decision that were
unwarranted by the Constitution. The idea next turned up in a message by
President Lincoln justifying his suspension of the writ of habeas corpus
without obtaining congressional authorization. And counsel to President
Johnson during his impeachment trial advertised the theory, but only in
passing. Beyond these isolated instances, it does not appear to be
seriously contended that the oath adds anything to the President’s powers.
There is "The Constitution for the united States of America" written and
adopted in 1787. This is the actual Constitution forming the union of
unincorporated organic land jurisdiction "States of America" into a union
(a form of association) of sovereign states, doing business as the
unincorporated United States of America. Notice that this unincorporated
entity was created "for" the States of America. These "States" are also
unincorporated entities. Notice that "unincorporated" is a synonym for
"sovereign". It was necessary to create and form this union of states first
in order to have a central body responsible for exercising all the "powers"
of the sovereign states in international jurisdiction BEFORE those powers
could be exercised in common or separated out and delegated to any other
party. This is the actual Constitution from which all other Constitutions
(debt agreements for services) are derived and upon which they all depend
for their existence. So, the unincorporated United States of America was
formed first, received the responsibility for exercising all international
powers in 1787, and two years later, delegated nineteen of its enumerated
powers to the British Monarch and His Proxy Government known as The United
States of America as described and organized under The Constitution of the
United States of America adopted in 1789. Notice that this foreign
British-controlled "district government" was created "of" the United States
of America --meaning "apart from, outside of, or belonging to" the United
States of America
