Providing that you have good records which show inspections at regular
intervals, a full fault history, a record of the original takeover
certificate and the check on detection plus green conflict after the
incident, you should be OK.

I had an instance where an officer claimed that she saw concurrent greens=
.
The records were sound and we responded within 20 minutes of the police
call, the judge said that he was satisfied that a green conflict did occu=
r,
but that due diligence had been exercised by the Authority so no cost wer=
e
awarded against them.=20

The interesting thing is why the officers alleged concurrent greens, what=

did they see and can you explain it?  If so, then you are home and dry.
Some time on site being cynical and watching, could be well spent.

The problem is that the courts do not understand that the police are no m=
ore
knowledgeable than the general public about signal operation.

As for no one at fault - they collided didn't they, both cars had drivers=

with a duty of care.

There are detectors to extend the all red and also quite a long intergree=
n
between phases as well. There are 6 such bridges here and we have had
tourists etc stopping to admire the view then been faced with oncoming
traffic.=3D20

In this case 2 police officers who attended the accident stood at either =
end
of the bridge and apparently agreed that both greens were on at the same
time. They then advised both drivers that no one was at fault because the=

lights were faulty.=3D20

I then explained to them how the signals operate and although it was
possible for vehicles to meet on the bridge, they must have got a green a=
t
different times. Unfortunately they are sticking with their story.
Funnily enough after witnessing such a dangerous occurrence they decided =
to
leave the lights switched on.

I'm now waiting for the insurance claims to come in from both drivers.
