[wsmac] Re: Fwd: Pedal and Walk Safely this Summer

All great reasons to avoid cycling in a crosswalk. Visibility and reaction
times are generally insufficient for any cycling speed much faster than
walking. And bikes are less maneuverable than feet.

Hi All WSMAC and Bicyclists  !!!

I want to add a bit more to my E -Mail from last week, regarding the
Tandem Bicyclist,  with a Tall Young Dad Pedaling across Main Street at
Vallee's Square, with a very young Daughter riding on the Rear seat. I
honestly do not remember if she was also pedaling.

They came thru the board walk from the new Bridge Street Bridge and then
pedaled across Main Street at the Courtesy Controlled Marked Crosswalk at
the Tanning Salon, towards the East Side of the CVS parking and Driveway.

This was late afternoon with lots of Traffic. What I want to point out
Here is There were:

1. Cars parked at the curb, westbound on Main Street.
2. Cars were Stopped on the West bound Travel Lane of Main Street in front
of the Tanning Salon, along with cars both waiting to Turn Right into the
former Bridge Street from Main Street as well as cars waiting to turn Right
West bound coming Out of the former Bridge Street.
3. There was Traffic heading East on Main Street in front of the CVS Store
and Driveway Entrance and maybe cars coming out from the CVS driveway. I
was 2nd in line eastbound on Main Street, when the Driver in front of me
suddenly had a Tandem Bicyclist appear right in front of him/ her ?,
pedaling across the Courtesy Marked Crosswalk, from the Tanning Salon side
of Main Street.

There was High Potential here for a Disaster but apparently, all Vehicle
Drivers were paying Attention ..... with Traffic moving slowly, but the
Driver ib front of me Stopped Suddenly - and I Stopped, then a quick look
in my rear view Mirror and the Driver directly behind me also Stopped, but
was very close.

Thank You,

In my opinion, bicyclists should walk their bikes across marked
crosswalks. State statute does not direct this explicitly; however, the
section
on pedestrians
<http://legislature.maine.gov/statutes/29-A/title29-Asec2056.html> does
not grant any pedestrian rights to bicyclists (some states do, but not
Maine), while the definition of "pedestrian" in the Definitions section
<http://legislature.maine.gov/statutes/29-A/title29-Asec101.html> is "a
person on foot or an operator of a wheelchair or a 4-wheeled or 3-wheeled
motorized wheelchair." My conclusion is that bicyclists *riding* in a
crosswalk are not entitled to the right of way as a pedestrian, although of
course motorists must still avoid hitting them if they can. But I would not
expect that the motorist could be charged using the pedestrian statute,
leaving the bicyclist possibly at legal fault for the crash.

Apart from the legal question, riding across crosswalks is also
considered pretty dangerous, because the cyclist is generally traveling
faster than pedestrian speed, and also lacks the quick maneuverability of a
pedestrian. (I am a family friend to a woman who got hit by a car while
biking across William Clark Drive at Central Street, back before the
rebuild when there was a marked crosswalk there, and she was a teenager.)
The question gets a little trickier when a bicycle or multi-use path
crossing is marked like a crosswalk, as in fact it is on the new Bridge
Street, where the boardwalk crosses. I'm not sure of the legal situation in
that case, but at least there are warning signs there. However, that is
*not* the case at the old Bridge Street by CSV; that is clearly a simple
pedestrian crosswalk. The bicyclists should have walked across that one for
sure.

Eric, maybe this would be more justification for bicycle Shared Lane
Markings on Main Street, possibly leading out of Vallee Square? Bicyclists
who view themselves as "pedestrians on wheels" naturally cross the
pedestrian bridge southbound and get right onto pedestrian infrastructure
from there. I don't how much cyclist behavior would be changed by the
presence of SLM's, but at least it would challenge the expectation of
cyclist use of pedestrian infrastructure. (I regularly see bicyclists
riding along the north side of Main Street between Vallee Square and Church
Street, and think about what would happen if a pedestrian were to exit one
of those business at just the wrong time. I also continue to worry about
bicyclists riding on the sidewalk across the front of the blind alley
between the Arabic Market and the Frog & Turtle.)

Funny/not funny observation about the "pedestrian on wheels" approach:
Acronym is *POW*.

The Pedal and Walk Safely this Summer is Appropriate given what I saw
late this afternoon.

Drivers, me included stopped at both sides of the marked Crosswalk /
Riverwalk Trail Sign on the downstream side of the new  Vehicle Bridge on
Bridge Street,
to let a Tall Young Dad and his Very Young Daughter, pedal East across
on the Crosswalk.  They were on a long Tandem Bicycle, each wearing
helmets.

I turned Left onto Main Street.
What happened next is, in my view,
Very Dangerous, depending on your perspective.

The traffic heading West on Main Street was quite busy. The Marked
Crosswalk for the old Bridge Street, now the new Green Pedestrians Only
Walking Bridge, and also For Vehicle Parking is also for Pedestrians
crossing to and from the CVS, Book and Quill, and the Municipal Parking Lot
in back of CVS, as well as for  Vehicles entering and exiting that Parking
Lot.  I was second in line heading East. Traffic heading West was Two Lanes
wide, one Lane turning into the former Bridge Street, and the other Lanes
going West towards the T Intersection of Main and Bridge Streets.  At the "
Courtesy "
Marked Crosswalk, from Old Bridge Street to CVS, I would like to see
more Drivers leave that Space Open,  mainly for Pedestrians, in both
directions.

As, the Driver in front of me, with his Line of Sight blocked by Stopped
Vehicles just beyond the Courtesy Marked Crosswalk, suddenly had that Same
Tandem Bicycle Right in Front of him, with the young Dad Pedaling across
the Crosswalk. I also Hit my Brakes and stopped in time with no problems,
The Driver directly behind me also Stopped, but Right behind me.

In your Bicycling Experience, John,
Should the Bicyclist walked his Tandem Bicycle Across the Courtesy
Marked Crosswalk ? Or was he in his Rights pedaling across a Very Busy
Congested Main Street on a late Monday afternoon ?

With West bound traffic essentially blocking the Line of Vision for East
bound Main Street Drivers at that Courtesy Marked Crosswalk.

Thank You,
Dennis
