You are soooo right!! I lived in the city of Milwaukee my whole life where I could have 3 dogs on my postage stamp city lot. While considering my current property, I asked the township if I could license my 3 dogs at the time, they said, "No Problem." The real estate agent said it was OK, and quite frankly, it never crossed my mind that with 8 acres, I'd have a 2 dog limit. The township licensed the dogs every year with no issues, even when the numbers of licenses I purchased got higher. I just recently bought a lot in a different area to build on and, after learning all this "county" stuff, made SURE I wasn't going to have any problem.. LOL Your clause in your purchasing contract is a great idea, btw. Your fellow club members' experience is EXACTLY why many don't even try to apply for the county license. Once you're turned down, you're screwed. Either move or find homes for your dogs. I also think it is unacceptable that townships don't know the county rules until they're forced to look it up after a formal complaint is filed. Not everyone understands how zoning works. I agree you should, and I do NOW, but I'm pretty sure I'm not the only one who had a township mislead them into believing they were in compliance with the law. When I was in the process of looking for a new place, I purchased township regs (yes, they actually sell them, lol), wherever I was interested in purchasing so that I had a clear understanding of the rules. Well, in come cases, the rules were clear as mud, and in others they actually contradicted themselves, so I actually had a clause inserted into my agreement of sale when I actually wrote an offer that I would receive a letter of understanding to my satisfaction from the township solicitor clarifying said regulations. (Which I obviously received, or I would not have gone though w/ the purchase.) I know one of our regional club members, Gina, that went through what you did, trusting her realtor that everything was just fine, except that it wasn't. She was never able to get a variance and after spending lots of money to improve her property was informed she had to get down to 4 dogs. So she moved....costly lesson, but one that I learned for sure! I would have spent more than one sleepless night in your shoes, then I would have thrashed the real estate agent for making me go thorough that! But seriously, for anyone buying property, the time to have all of your demands fulfilled is before you do the deal, and with something as important as understanding what compliance re dogs is, I'd never leave that to someone else! I went to the townhall, bought 5-10 dog licenses, depending on which year it was, and believed I was in compliance with the law. It was at a town hall meeting that I realised that the township rules were different than the county. Also, that the county rules RULE! Some poor dog owner, not unlike myself, received a complaint regarding the number of dogs on their property. Since they didn't have a proper "county" kennel license, they were ordered to decrease the number of dogs they owned within a specified amount of time, or face daily fines until compliance. **************It's only a deal if it's where you want to go.
