Lew said he would send the letter, the deadline was coming..........so Carmen just EXCUSE ME............signs Lew's name to it???????? Jm tried to pass it off as a "mistake"? That is fraud pure and simple............that is NOT a mistake! In the broadest sense, a fraud is a deception made for personal gain. The specific legal definition varies by legal jurisdiction. Fraud is a crime, and is also a civil law violation. Many hoaxes are fraudulent, although those not made for personal gain are not technically frauds. This is gray for me and here's why; in years past, in business, with someone's authorization (and I'm dating myself because this is wwwaaaayyyyy before everyone had a fax on their home computer), there have been times when someone missed a signature on a form, they were pushing for a deadline (again, WITH their authorization), that I printed their name and wrote my initials, smaller, to the top right of a signature line. In our family, and again, dating myself because at this point we've got so many Powers of Attorney between us now, there isn't much we CAN'T sign, I signed everyone's name routinely (bank stuff, stock stuff, personal stuff.) Funny story, when we lived at home and we were all in school, mom routinely deposited everyone's (meager!) work checks. Years later, when I was managing a small office for one of my first "real" jobs, I went to a different bank branch than usual I and wanted to cash a $100 check to have petty cash on hand. Nope. Lots of discussion, microfiche examined, me with a whole wallet full of ID....the bank line was getting longer a phone call to a bank VP (MY FATHER!)....My signature didn't match what was in their records (mom's!!!!). I wrote my name again, how mom would have done it (!!!!!) and they cashed the check. In fact (and this is REALLY dating mom, but I'll bet some have mothers from this generation, in fact she and Carmen are close in age...), even though my parent's names both appeared on their personal checks, my mother would write a check and sign my father's name (not her's even though she was on the account). Between friends...ever date somebody and use their credit card? Ever sign for a Fed-X or UPS package NOT addressed to you? Ever have a co-owner say "oh just sign it"? Me thinks the only time we see names in the back of the Gazette is when parties gave a verbal OK to one another, then later have a fight. Is it right? No. Is it "done"? Sure. Anyway, for me it's not so "pure and simple". I don't see any real bad intent. It didn't work out, and let this be a lesson not to sign a name, but for me...very gray.
