a binding contract simply means everyone lives up to the WRITTEN terms of the
contract, its makes no difference what the contract says ( where is Evan when
we need him)...as long as there is consideration ( a legal term) on each
side...what ever both parties agree to they can also agree to binding
arbitration through the GSDCA Ethic's committee...we need to police ourselves
better...all I am really saying is live up to the terms of your contract...and
please have one...Ed

Tell me how you can come up with a binding contract when the buyer sends an
agent to select his puppy? To me..this absolves the breeders of any
responsibility. A contract is only as good as the money you want to spend
on attorneys to enforce it. Before you sent a deposit check to the below
..the dog should have been x-rayed first..and copies of the films sent to a
vet of your choice for re-evaluation. then the money transacts. When I pre
-Xray before a sale..if the dog x-rays clear..the buyers pays for the
films..if the dog doesn't x-ray..I pay for the films If the buyer fails to
come through after I have spent the money and found the dog to x-ray
clear..so what.that is to my benefit and to the benefit of a future buyer.I
do STRESS, to prospective buyers that these are pre-lim evaluations and
there is still an element of risk involved with OFA when the dog turns two.
Since we don't breed frequently, if I owe someone a replacement, it might
take awhile. I don't want to replace a dog with another that won't turn
out..and as I have stated, it may take awhile to get a good one.Christine
