Article 1, Section 8 " The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States..." Welfare defined as: n. 1. health, happiness, or prosperity; well-being. This works for me, but I have learned over the years that disputes over process are really about policy. Those who favor health care reform tend to be satisfied that Constitutional tests are met, while those opposed are not. In any case, the sanctity of the Constitution has much to do with contemporary socio/economic climates and who is in charge, as you tacitly acknowledge by blessing our pro-corporate biased Chief Justice.
