used to be counted as 25 open letters. Beginning 8/28/22 (providing that the
PA is appointed as both guardian and conservator for all 25), those same 25
clients will be counted as 50 open letters. That is correct. To elaborate on
your (correct) point, some judges were already counting them as separate
letters, in these cases, nothing will change. It will for those counties where
they were NOT counted separately (we believe this is about half of the judges
for 'part-time PAs').
Since the statute clarified what constitutes an open letter, are counties able
to look back at the previous two years and count those letters separately? No,
unfortunately, the law is not retroactive. Or does the counting of separate
letters begin on 8/28/22 and move forward from there? Correct
If a county's salary commission votes to adjust the PA's salary, does statute
indicate that this would take effect on 1/1/23 (as with the recent salary
increase for sheriffs) or would it take effect at the beginning of the PA's
next term? As of August 28th, the statute that says the salary commission may
pay a PA according to the assessed valuation schedule will be in effect. That
means the next time the salary is determined this statute is in effect and can
be referenced (after August 28).

Danielle,
The statute technically goes into effect on August 28th. As it relates to
"part-time" PAs though - the way statute is written the "salary shall be based
upon the average number of open letters in the two years preceding the term
when the salary is elected" - in other words - beginning August 28th, judges
should be counting guardian and conservator letters as two separate letters. It
will be a bit before we will really see the impact of the change. (two years).
Please let me know if that makes sense or if I can provide you with any further
clarification.
