I'm getting queries from financial and mental health professionals about
this event, so I want to clarify what the advanced training does and doesn't
offer.
The trainers are both collaborative lawyers; there are no trainers from
other professions at this event.
The intent is to focus intensively on the lawyers as "gatekeepers," and also
as holders of the dispute/conflict resolution paradigm that will shape the
negotiations process. The work will aim first at deepening the
understanding of the differences between dispute resolution and conflict
resolution, and how the lawyers' nuanced understanding of those differences
shape and limit what may be possible for the clieints to aim for and to
achieve, even in a collaborative divorce team case. Secondly, the work will
focus on how this deeper and more nuanced understanding can be integrated
into, and transform, how lawyers handle the "informed choice" or"buy-in"
phase of the collaborative process, with an intention to help participants
see how they can do a better job of meeting lawyers' emerging ethical duties
regarding informed consent, while at the same time enhancing the likelihood
that clients will want collaborative representation, and enhancing the
conflict resolution tools that are laid in place at the front end of the
case. Thirdly, the work will focus on building a more well informed
understanding of interdisciplinary team practice, as it plays out in the
informed choice phase between lawyer and client, again with the intention
that lawyers will both do a better job of meeting ethical requirements while
at the same time increasing client "buy-in" to collaborative divorce team
representation. And, finally, we will spend quite a lot of time on building
stronger collaborative lawyering skills during the midgame phase of
negotiations, including when apparent impasse arises.
The roleplays are intended to focus on enhancing the lawyer skills that are
the limiting factor, even in interdisciplinary practice groups, in expanding
client choice of collaborative divorce, and the limiting factor also in
effective collaboration during rough spots in the process. There will also
be case conferencing to help participants learn from challenges in prior
cases.
As you can see, the course is aimed at the needs of lawyers but is intended
to have a powerful effect on interdisciplinary practice back home in the
participants' practice communities. If members of financial or mental
health professions want to attend, they would certainly enrich the dialogue
but need to understand that it is not a team training and that the
interactive components are structured to teach lawyers what we are now
seeing is the main need in many practice groups in order to take the work to
the next level.
