Colorado's Ethics opinion is based on Colorado's unique version of the ABA
Model Rules and is "advisory" only with respect to the professionals who
practice there. Colorado's collaborative professionals are certainly well
advised to continue using a two stage agreement to collaborate at least until
their January 2008 rule change, but such separate agreements should not be
necessary anywhere else. For a thorough discussion of the applicability of the

Well that's a breath of fresh air and common sense reasoning in the
new ABA opinion! Note, too, that the opinion refers repeatedly to a
"four-way agreement" -- presumably, a SINGLE agreement with both
clients and both attorneys signing. So do we go back to that?
