Yes, all the 'groups' have trademark and copyrights on their logos, and yes,
they 'do' license the images. BUT this is NOT to mean you cannot do work for
the local groups. The companies that pay for the 'license' make up all kinds of
products to SELL to the groups-they are not doing 'custom' work like you do.
They would have a full catalog of 'authorized' products that they paid a fee to
be able to MARKET like any catalog sales company. Jackets, mugs, frisbees, you
name it-they'll have it.
For 'our' purpose-you are getting a custom order for a particular item for the
sole use of your local club-you aren't selling them something you already have
done in bulk, so to speak-they are coming to you for a custom order. As long as
they supply the 'national approved' logo/artwork, and the order is placed by an
OFFICER or authorized member with permission to do so-you can take the order.
Same with any auto dealer (Ford, Jeep, etc.) they all have the license to use
the national logo FOR THEIR OWN PURPOSE. But if YOU produce sweatshirts, for
example with 'Elks' or 'Ford' logo on it-to sell to anyone walking through the
door-that's a violation of the copyright/trademark-because an authorized person
of that company or group did not ORDER the items from you. All groups and
franchise businesses will have an 'advertising packet' full of authorized
logos, PMT's, artwork, ad layouts, etc. with instructions on what they are
authorized to use them for. Usually in a civic group, the
'secretary' person will have that info and not even know it.
