I could sit in court and back up everything I just wrote with dates and
documents. I told the truth. Hamstreet told a lie. I think they’re all in this
together, they’re all sleazy.
I hope that there is justice tomorrow; Tim Dack’s motion was a bright spot in
my day. Read it, it’s worth your time.

The receiver tells an outright lie in his report, namely that he does not
have the signed documents on the marina transaction. Those were provided him
with my proofs of claim for the IRA I inherited from my late father and the
marina loan. Those were secured in 2015, when upon AEM’s default we amended
and restated the promissory notes.
It’s strange that the receiver doesn’t tell the whole story (omitting the
IRA from the discussion), and then also lies, that he doesn’t have the
signed documents.
The proof of claim face sheet includes all of these facts, and Knapp was
also notified that we intend to proceed against the collateral. I also
identified myself in writing via email as the sole owner of that LLC and
explained the situation.
Boy, it’s a good thing that Hamstreet and Miller Nash et. al. have such a
“fine reputation”!! I guess that means you can play fast and loose with the
truth, in writing, to the investors for whose benefit you are working.

Notice that Hamstreet dismisses our of hand the possibility of
getting anything out of banks, title companies, etc.
Also, to me it is jaw-dropping that none of this is considered
criminal. Just how it looked at first glance (like a Ponzi scheme)
would have prevented an ethical person from accepting the engagement.
It is definitely in the territory where the lack of objectivity of
the receiver and his interest in continued billings (he is getting
paid, remember, out of the income Ross and Maureen are still making).
