Thanks for this Phil,

They do quote the FOIA in order to 'encourage' you to fill in their=
 'questionnaire' - I was going to have a word with our FOIA officer and see=
 if we might get a tenner out of the CCTV inspectorate for the privilege of=
 doing so!

The CCTV inspectorate is very well known in security circles.  They are in=
 effect selling training in something that is not required.

Their letter at first glance appears to be from a Government Organisation,=
 and at second glance you may want to ignore it, but please be aware that=
 they normally make their request under FOIA so your Authority may choose=
 to answer it. =0D
We did but not exacly helpfully.

"I have today spoken to Jonathan Bamford, the Assistant Information
Commissioner and the conclusions are as follows.

The company called CCTV Inspectorate and CCTV Data Compliance
Inspectorate has no relationship with the Information Commissioner's
Office. They have no Official backing of any sort and they are not
'inspecting' in any official capacity.

As a result of communication between the Commissioner's Office and the
company concerned, they have now removed the FAQ's section from the
mailshot they have been sending out.
=0D
With regard to the questionnaire, the company (and /or Mr Johnson), has
the right, like anyone else, to make a request under the Freedom of
Information Act (FOI Act). You are obliged to respond within working 20
days. You do however, only have to supply information that is 'held' by
your Authority. This may vary from authority to authority. You do not
have to supply personal data that may be protected under the Data
Protection Act if to do so would breach a DP principle, although if you
have already made that information public (on your web site for
instance), it is unlikely that this would be the case.

It is up to authorities to make sure that they discharge their FOIA 2000
obligations correctly. However, you may want to answer the questionnaire
in a format similar to the below example, please bear in mind that he is
asking the Authority and not just the Town centre systems, so you may
have to consult with other departments to establish exactly how many
systems the Authority owns/ manages or controls.

Dear all,

Just received a letter from a company calling themselves "The CCTV Data=3D
Compliance Inspectorate" offering the services of one of their=3D
'inspectors' with regard to our compliance under the Data Protection Act.=

Being of a suspicious nature I have checked with the Information=3D
Commissioner - who confirm that 'Bogus Agencies' do operate 'scams' of=3D
this nature and whilst not strictly illegal, since they offer a service of=
=3D
sorts, they do have concerns about how they represent themselves in their=
=3D
advertisements.
