I wish to respond to your Email as much as I possibly can to the best
of my knowledge and hope that others will fill the gaps.
- Why, is it, that Kenya has not ratified this treaty?
The bureaucratic procedures in Government and the lack of a strategic
approach in lobbying among interested parties is to blame. The fact
that for a while there was little or no interest or understanding led
to costly delays. For instance, the Cabinet had directed in 2013 that
the AG’s office works with the Foreign Affairs Ministry to draft the
memorandum that was to be presented to Parliament. This took more than
two years!
I also believe that the fact that the group lobbying for the
ratification has been moribund is responsible.
- What obstacles are facing our country or representatives to ratify
This treaty?
The memorandum and bill was to be forwarded to the National Assembly a
couple of months ago; neither Hon. Josephine Sinyo nor I was able to
confirm whether indeed it was sent to Parliament.
I am informed that this is the process for it to be ratified.
- are there people who are doing this work or are there
Representatives who are working on this?
This work squarely is for Government. The lobbying though is mainly
being undertaken by CSOs through individuals who are working on a
voluntary basis to lobby Government for ratification.
Our one and only Hon. Mwaura’s attention has also been drawn to this cause.
Some of these individuals have made use of their positions and
stations in life to pursue the cause. For instance, Stanley Mutuma of
the Judiciary, Josephine Sinyo of the Kenya Law Reform Commission and
AG.
Dr. Sam Kabue, as ever, tackled it from a broader perspective by
looking at the entire East African region and mobilizing relevant DPOs
to act. I have also been working on this cause from the AFUB/KUB
approach and also from my position at the Ministry of Education. I was
given the responsibility of chairing the team of stakeholders that has
been pursuing this matter.
Stan and I pushed our institutions to send petitions to the AG.
The Kenya Copyright Office also took an interest in the matter
considering the issues around copyright and the reluctance by
publishers.

persuaded that this is a Treaty that can only bring goodies to all of
us!

forum is to seek this kind of information!

when I was reading and going through the list of countries that have
radified the treaty, I did not see Kenya in the list.
and, I must say; at this point, I felt myself break a sweat on my
forehead, and, went into a small panic attack.
