Vet script to exercise a dog on a mill, an hour a day walk, no advertising
puppies on the web... see underline... ALL "hobby" breeders will now be
defined as a "retail pet store"....  pay attention folks, this is the type
of language that will bury us....
On Friday morning - HSUS has just introduced anti-pitbull, anti-breeder
legislation - with the help of key members of congress.  Here is some of the
language - beware:

  S.3519. A Bill to Amend  the Animal
  Welfare Act to provide further protection
  for puppies; to the Committee on
  Agriculture, Nutrition, and Forestry.
  Mr. DURBIN. Mr. President, today I
  am introducing the Puppy Uniform
  Protection and Safety Act, or PUPS
  Act.
  In recent years, media reports have
  highlighted the cruel treatment of dogs
  raised by irresponsible breeders in
  large-scale commercial operations. The
  facilities operated by the most negligent
  owners are often referred to as
  puppy mills, because they churn out
  dogs the way a factory wouldbwith little
  or no respect for the animalsb quality
  of life.
  Let me be clear, there are many responsible
  dog breeders across the country
  who care about and take great
  pains to properly look after the animals
  in their care. Those breeders are
  not the target of this legislation.

  Unfortunately, the less scrupulous
  bbpuppy millsbb threaten the reputation
  of the entire industry. The dogs bred or
  raised in puppy mills are often housed
  in cramped, dirty, wire cages. To maximize
  profit, a breeder may stack cages
  on top of each other or keep the cages
  outdoors where dogs are exposed to the
  elements. The dogs may never be given
  a chance to exercise or even walk on
  solid ground. Some animals rescued
  from puppy mills show signs of malnutrition
  and dehydration, having been
  denied a sufficient supply of food and

  You canbt blame people for using the convenience
  of shopping online, but some
  puppy mill operators advertise on the
  internet so that they can bypass the
  pet store. That way, the breeder can
  avoid the Federal licensing requirements
  of the Animal Welfare Act,
  which apply only to wholesale breeders.
  That means that finding your
  puppy on-line may well increase the
  chance that youbll be buying from a
  puppy mill.
  The PUPS Act I am introducing
  today, along with Senators FEINSTEIN,
  MCCASKILL, and WYDEN, would amend
  the Animal Welfare Act to require that
  breeders obtain a license from the
  USDA if they raise more than 50 dogs
  in a 12-month period and sell directly
  to the public.
  These licenses are inexpensive and
  the application process is simple. But
  USDA licensing would allow the agency
  to ensure that large and mid-level
  breeders comply with minimum Federal
  standards. The PUPS Act also requires
  all commercial breeders to give
  dogs in their care at least two daily exercise
  breaks, allowing the dogs to
  enjoy at least 60 minutes outside of
  their crates or enclosures.
  The good news is that the public is
  growing more aware of the existence of
  puppy mills. Recent investigations of
  the deplorable conditions at several
  large puppy mills along with the interest
  shown by celebrities, including Chicago
  resident Oprah Winfrey, have
  brought new attention to the cause. As
  a result, many Americans seeking companion
  animals are doing their homework.

  They are choosing to adopt from
  local shelters or finding and visiting
  responsible breeders. It is my hope that
  extending and improving oversight of
  this industry through the PUPS Act
  will help Americans feel confident
  about the health and well-being of the
  dog that they welcome into their family.

  Be it enacted by the Senate and House of Representatives
  of the United States of America in
  Congress assembled,
  SECTION 1. SHORT TITLE.
  This Act may be cited as the bbPuppy Uniform
  Protection and Safety Actbb.
  SEC. 2. REGULATION OF HIGH-VOLUME SELLERS
  OF PUPPIES.
  (a) RETAIL PET STORE DEFINED.bSection 2
  of the Animal Welfare Act (7 U.S.C. 2132) is
  amended by adding at the end the following
  new subsection:
  bb(p) The term bretail pet storeb means a
  person thatb
  bb(1) sells an animal directly to the public
  for use as a pet; and
  bb(2) does not breed or raise more than 50
  dogs for use as pets during any one-year period.bb.
  (b) LICENSES.bSection 3 of the Animal
  Welfare Act (7 U.S.C. 2133) is amended in the
  second provisob
  (1) by striking bbretail pet store or other
  person whobb and inserting bbretail pet store,
  or other person who (1) does not breed or
  raise more than 50 dogs for use as pets during
  any one-year period, and (2)bb; and
  (2) by striking bbresearch facilitybb and inserting
  bbresearch facility,bb.
  (c) HUMANE STANDARDS.bSection 13 of the
  Animal Welfare Act (7 U.S.C. 2143) is amendedb
  (1) by redesignating subsections (g) and (h)
  as subsections (h) and (i), respectively;
  (2) by redesignating the second subsection
  (f) as subsection (g); and
  (3) by adding at the end the following new
  subsection:
  bb(j)(1) Subject to paragraph (2), a dealer
  shall provide each dog held by such dealer
  that is of the age of 12 weeks or older with
  a minimum of two exercise periods during
  each day for a total of not less than one hour
  of exercise during such day. Such exercise
  shall include removing the dog from the
  dogbs primary enclosure and allowing the dog
  to walk for the entire exercise period, but
  shall not include use of a treadmill, catmill,
  jenny mill, slat mill, or similar device, unless
  prescribed by a doctor of veterinary
  medicine.
  bb(2) Paragraph (1) shall not apply to a dog
  certified by a doctor of veterinary medicine,
  on a form designated by and submitted to
  the Secretary, as being medically precluded
  from exercise.bb.
  SEC. 3. EFFECT ON STATE LAW.
  The amendments made by this Act shall
  not be construed to preempt any law or regulation
  of a State or a political subdivision of
  a State containing requirements that are
  greater than the requirements

  Federal Lawmakers Introduce Bill to Crack Down on Abusive Puppy Mills
  Legislation Seeks to Close Loophole in Animal Welfare Act that Allows
Internet Breeders to Sell Puppies without any Federal Oversight
  WASHINGTON (Sept. 19, 2008) b The Humane Society of the United States and
Humane Society Legislative Fund commend federal lawmakers for introducing
bills that will crack down on abusive bpuppy millsb in the United States
b where breeding dogs are often stacked in wire cages for years to produce
litter after litter. The legislation will close a loophole in the Animal
Welfare Act that currently allows large, commercial breeders who sell
puppies online and directly to the public to escape licensing and
regulation.
  The legislation b known as the bPuppy Uniform Protection Statuteb
(PUPS), or bBabybs Billb in honor of rescued puppy mill survivor Baby who
is the subject of Jana Kohlbs new book A Rare Breed of Love b was
introduced in the House of Representatives yesterday as H.R. 6949 by Reps.
Sam Farr (D-Calif.), Jim Gerlach (R-Pa.), Lois Capps (D-Calif.) and Terry
Everett (R-Ala.). A companion bill was also introduced in the Senate by Sen.
Richard Durbin (D-Ill.).
  The bills also require that dogs used for breeding be removed from their
cages for exercise every day. Female breeding dogs in puppy mills are
typically forced to live their entire lives in small cages with no
opportunity for exercise, no socialization, and little human interaction.
  bDogs are not livestock, and they shouldnbt be treated like a cash
crop,b said Michael Markarian, executive vice president of The Humane
Society of the United States and president of the Humane Society Legislative
Fund. bWe are grateful to federal lawmakers for introducing this
legislation to curb the worst abuses in the puppy mill industry. Itbs a
much-needed upgrade to our nationbs laws that protect manbs best friend
from cruelty and harm.b
  Facilities that breed dogs for commercial resale through pet stores are
required to be licensed and inspected under the federal Animal Welfare Act.
But thanks to a gaping exception in the law, puppy mills that sell directly
to the public are exempt from any federal oversight whatsoever. Unregulated
Internet sellers and other direct sales facilities sell thousands of puppies
a year to unsuspecting consumers. Due to improper care, their puppies are
often sick, leaving outraged consumers with frail, sometimes dying puppies
and high vet bills. Meanwhile, the breeding dogs at these facilities often
spend their entire lives in constant confinement and deprivation.
  bSadly, finding your puppy online may well increase the chance that
youbll be buying from a puppy mill,b said Sen. Durbin. bOur bill simply
requires that breeders obtain a license from the USDA if they raise more
than 50 dogs in a 12-month period and sell directly to the public and sets
forth reasonable standards of care for commercial breeders. Responsible dog
breeders are not the target of this legislation, but hopefully it will put
the puppy mills out of business.b
  bMy work supporting puppy mill regulation goes back to my time in the
California Assembly where I championed California's puppy mill law,b Rep.
Farr said. bI think itbs very important that Congress take the time to
address issues like animal welfare. These are the kinds of issues that
really demonstrate who we are as a society.b
  bIbm proud to join with Congressman Farr and representatives of The
Humane Society of the United States today as we continue our efforts to
ensure that commercial dog breeders are appropriately regulated,b added
Rep. Gerlach. bOur bill, the PUPS Act, will close a loophole in current law
that allows large breeding operations avoid any and all oversight. I am
confident that this bill will not hinder the operation of reputable and
responsible breeders. Instead, it is aimed at protecting dogs and making
individuals who are motivated by profit over the fair and humane treatment
of dogs accountable for their actions.b
  The legislation will close the loophole in the AWA that allows thousands
of commercial breeders to go unregulated. It will require the following
changes to the AWA:
    a.. All dog breeders who sell more than 50 puppies per year directly to
the public will be federally licensed and inspected; and
    b.. Dogs at commercial breeding facilities must be given the opportunity
to exercise for 60 minutes a day.
    c.. The bill will not affect small breeders and hobby breeders who sell
fewer than 50 dogs per year directly to the public, but is crafted to cover
only the largest commercial breeding facilities.
  Public concern about the inhumane conditions typical in puppy mills is at
an all-time high, due to coverage on national television and several
large-scale cruelty investigations and rescues from puppy mills this summer
that The HSUS and local shelters spearheaded. Earlier this year, the Farm
Bill passed by Congress included a new provision to ban the importation of
puppies under six months old from puppy mills in China, Russia, Mexico and
other foreign countries.
