These people in our legislation need to get some education about reputable
breeders!
To say the law is aimed at puppy-mills and not reputable breeders who sell to
pet stores is the most ignorant statement I have read or heard all week! (If
it weren't for the idiot I met last week, I'd say my entire month!!!) Really
now, what reputable breeder (of ANY breed) would sell their pups to a pet shop?
What is the limitation of damages? The maximum small claims court allows? The
purchase price of the dog? None?
I wonder what effect a law like this would have on the responsible breeder's
contract? Which supersedes the other? The lemon law or a contract between
buyer & breeder (when health guarantees are spelled out)? Does the breeder get
any option/right to have a pup examined by an independent veterinarian?
I am frightened about the last point- as mentioned in a previous post a vet
says "don't get a Dane"... Bet y'all a dollar the next Dane pup she sees she
will have a biased view/opinion on what quality that pup is, thinking they're
all bad genetically and can't help themselves... They're all a mess... Etc.
I took one of my boys (at 31 months) in for his PennHIP. Apparently, that
veterinarian didn't like GSDs, as during the consult, he tried to tell me my
cardiac certified boy had a grade 3 heart murmur (and like that wouldn't have
been noticed before 31 months old) so why should I waste my money on having his
orthopaedic testing?!? He was dead serious when he said it to me too.(!!!) He
went ahead and did the tests when I persisted- this boy is my SD- and only that
seemed a valid reason for him to do the tests... That I wanted to know if he
had healthy joints so he could work his job. When I came in to pick him
up/view x-rays, the vets tune changed; he couldn't believe my dog had such good
hips and still be a GSD. (But he at a .26/.29 90%ile was a fairly normal
score to me, with my own dogs' having DIs from as low as .19 on up to .33 for
the single worst hip of the lot. That .33 is still better than 80% of the GSDs
evaluated by the PennHIP method.)
So- what if this guy were your puppy's regular vet- he outright lied to me
about my adult dog- and next time we went to a vet (I used this guy once, and
only once b/c he was the only one in my area who did PennHIP exams where i
lived at the time... I found another clinic for my next dog!!!) I had him
thoroughly cardiac checked while I relayed my story. He was clear a second time
too... (Considering the head of the AR state board did his cardiac the first
time I was confident he was indeed fine... But that mean vet had me freaked out)
Imagine that happens to the average pet buyer, not a super-savvy vet tech and
breeder/exhibitor!!!! The unscrupulous veterinarian sure could be padding
their pockets soon in New York if the law doesn't provide for an opinion from a
vet of the breeder's choice...
Go after the Hunte corporation if governments/people wanted to close down the
puppy mills. That's where the large number of pet store dogs come from.... Not
small-breeder operations.
Gotta Love the American way: make more ambiguous laws when we're not enforcing
the ones in place that do the same or better as the new...
