suits no one will ever serve on the board." My responce is that why should the
members support someone, hell anyone, who ignores the Parlimentarian or the
Attorney that were on the Board .
We still have members, that have stated privately "they have never read the
lawsuit" We have Board members how apparently have never read the P&P or the
By-Laws. Most of this would never have happened if they had.
If we can not find 19 members who can work TOGETHER without shouts or threats
for the betterment of the BREED, then maybe the PC should fold. Many members
are asking "What benefit does the PC offer that I can not get without the
hassle."
I do hope that the member at the July meeting who threatened to sue the PC if
the lawsuit was posted, reads his Renewal Form". Page 66 October REVIEW "As a
condition of membership in the GSDCA, the undersigned member(s) agrees that for
ANY CAUSE of ACTION; CONTROVERSY or CLAIM ...... a member will not sue but will
agree to abritration in Albany New York. What are the Board Members afraid of??
This Motion was seconded and passed UNANIMOUSLY. I personally would have
thought that a matter of this importance would have required a Membership Vote.
I believe this wording came from a similar motion in the WDA.
THIS BOARD better have some answers and have them FAST. Many long time members
have already quit, many more may not renew in December.

There has been much discussion about the settlement that Marjorie has
proposed. What I have not seen is an offer for her to release the board
members in their individual capacities. As everyone will recall, I believe
that Marjorie initially sued each of the board members in their individual
capacities. Again, I believe that the case against the individual board
members was dismissed because the court lacked jurisdiction. However,
Marjory is not prohibited from bringing those cases again and in addition, I
believe that there have been many other allegations made about the conduct
of board members since the initial suit was commenced. If the board members
settle the case with Marjorie but are not released themselves, then it is
possible that Marjorie (who represents herself) could file another lawsuit
against them and then this lawsuit may not be covered by the GSDCA insurance
policy. Then what would the board members do? They would have to spend
their own money defending themselves.
I understand that some people have stated that this is the exact reason why
the board members have a conflict of interest and should therefore excuse
themselves from voting on settling with Marjorie. My response to that is if
the club does not support its board members from suits no one will ever
serve on the board.
In conclusion, no board member would ever agree to Marjorie's offer of
settlement unless they were personally released. This is very common. I
just don't know if Marjorie has made such an offer, but this could be what
is holding up the settlement.
