They are a nonprofit if they do not breed and sell the dogs. The dogs are not purchased and sold at a profit. Most rescue's that have more than 9 dogs register with the state. Even so, I know the humane officer runs a rescue from her house which is not registered "nonprofit" with the state but she said it will not effect her. As long as they do not breed and sell dogs they are considered a nonprofit.
