Did your dog ever bark at someone playfully, and scare them?
Better keep him out of Virginia if this thing passes.
Virginia already has a 'dangerous dog law' based on behavior -- a
bite, an attack, injuries -- that's likely to leave physical evidence.
HB 2723 would add a new category, 'potentially dangerous.' The
definition is: "any dog that has, when unprovoked, endangered a
person by exhibiting dangerously threatening behavior normally
associated with an attack." Notice that this requires knowing
what a dog's behavior means; no physical evidence is involved.
Do you trust your neighbor's doggy behavior expertise? How 'bout
the one down the street who thinks it's your dog that makes the
deposits on his lawn? Okay, what about your ACO?
In some parts of Virginia, an ACO will be able to simply point at
your dog and say he's 'potentially dangerous,' no court hearing is
required. There's a fine of up to $500 and specific rules about
physical restriction. Also you must have liability insurance of
$100,000 covering the dog; since you probably won't be able to
afford that, your dog's dead.
You can appeal the ACO's determination to a district court; you got
the money for a lawyer?
This is a bad, bad bill; it needs to be beaten. And we don't have
much time. It will be heard TOMORROW, Wednesday, in the
House Ag Committee so get those emails and phone calls out as
quickly as you can!
