Dear RCTA Members, RCTA has received a mail from President, Confed ITA., Pindichery. The service tax department has raised a demand against all those IT partners who has received Backends or Incentives or Discounts on their Purchase under the Various promotional Schemes where the material has been purchased through the National Disty's. This issue is very boiling issue and later or sooner it is likely to touch all of us. Similarly the Delhi Sales Tax aurthorities has raised the VAT Demand to a few CMDA members in Delhi. Same can be followed by Rajasthan Sales Tax Authority. To tackle the Service Tax Matter, Please follow the iguidelines immediately as given below : 01. All affected dealers should immediately register your names and other relevent details with RCTA so that the same can be compiled and shared with CONFED ITA task Commiittee. ( Probably All direct dealers of Acer, HP, Dell, Microsoft, Toshiba, Intel, Samsung, LG, Epson, Wipro, Viewsonic, Xerox, TVSE, IBM, Lenova..... etc etc ) 02. write to your respective vendors demanding service tax on backends received since 2004. 03. Consult your auditors and raise necessary debit notes and include your suppliers and the distributors also so that they will be party in future litigations if necessary arises.
