If this is the case as you assert, then the FCC was also PERFECTLY within its rights to re-re-classify boradband service in 2017 back to the pre-2015 definition. It's disingenuous BS to claim otherwise. That is the danger of having an arbitrary board decide these things rather than through the proper law-making channels. What one regime givith, another regime can taketh away.
