IN THE MATTER OF ESTATE OF HEARD
Leagle.com

Those expenses include benefits
unrelated to the injuries that were the
subject of the settlement received
based on his fall in the nursing
home,...

snip

It is undisputed that Surrogate's
Court had allocated the entire amount of
the settlement to decedent's pain and
suffering, and that DSS asserted a
claim against the proceeds of the
settlement for the Medicaid payments it
made on behalf of decedent from 1995
until his death in 2003. Relying on
Arkansas Dept. of Health & Human Servs.
v Ahlborn (547 U.S. 268), the
objectant contended that DSS could
recoup only that part of the settlement
that was paid for medical services
provided to treat decedent for the
injuries related to his fall in the
nursing home.

Officials with the North Carolina
Division of Public Health confirmed on
November 12 that investigators believe
the improper use of blood glucose
level testers are most likely behind
the cause of a hepatitis B outbreak
at a Mount Olive, North Carolina,
nursing home.

Five of the eight patients that
contracted the disease have died from it,
according to ABCLocal.go.com. State
investigators say that during
interviews with Glen Care of Mount
Olive Assisted Living employees, one
admitted that the same blood testing
needles were shared between patients
at the facility.

North Carolina Nursing Home Hepatitis
Deaths Linked to Dirty Needles
The reuse of dirty needles at a North
Carolina nursing home probably
caused the deaths of at least five
elderly residents, according to state
investigators. There have been eight
diagnosed cases of hepatitis B among
residents at Glencare of Mount Olive
Assisted Living Center in Mount
Olive, North Carolina. Five of those
people have died and the likely cause
of the infections was the reuse of
needles used to check blood glucose
levels in diabetic patients, according
to health department officials.

Officials say that each resident of
the assisted living center should have
had their own private glucose testing
kit, but instead the facility used
the same kits and needles for multiple
patients.

Not in TX/SW but worth knowing about:
Racial preference a challenging issue

This case, Chaney v. Plainfeld
Healthcare Center, 612 F.3d 908 (7th Cir.
2010), involved a healthcare facility
that provided long-term care for
close to 200 residents. One resident
complained that she did not want
assistance from black nursing assistants.
The healthcare center acceded to
this request, placing a note on the
daily assignment sheet stating that
the resident prefers no black nursing
assistant. Two other residents
also made comments on separate
occasions that they disliked having black
nursing assistants attend to them.

Drug-resistant bacterium raises
alarms in Chicago

Superbug resistant to most antibiotics,
even the strongest A dangerous,
often deadly bacterium resistant
to the most powerful antibiotics known
to medicine is spreading in Chicago
hospitals and nursing homes, prompting
an effort to mobilize a regionwide response.
Known as KPC for short, Klebsiella
pneumoniae Carbapenemase bacteria are a
drug-resistant form of a common pathogen
that was first reported 11 years
ago in North Carolina. Earlier this
year, 37 health facilities in Chicago
reported an average of 10 KPC cases
each, up from an average of four cases
in 2009 in 26 facilities, according to
a new study presented Friday at the
annual meeting of the Infectious Diseases
Society of America. The
resistant bacterium was first identified
in Chicago in December 2007.
"Although the number of infections is
small, the fact that so many places
are seeing KPCs is very concerning,"
said Dr. Robert Weinstein, interim

chairman of the department of medicine
at Stroger Hospital and chief
operating officer of the Ruth M.
Rothstein CORE Center for HIV/AIDS at
the Cook County Health System.
