Well, the point is, if legal arguments are W3, then do they do not have to
say anything substantive about W1. Many of them can be arguments about W3.

To cite another case, a man shot two other men in a bar, after some
argument. The event was captured on video and there was no substantial
dispute about what happened as to W1 physical events. The argument that
preceded the shooting was audible on video as well. The legal dispute
however revolved about whether he had reason to fear those guys - who did
not exactly have a peacable reputation themselves, and uttered a threat or
two before the shooting - and whether his acts could be seen as
overstepping the boundaries of legitimate self-defense instead of a murder
or manslaughter. Such disputes seem to me to have a strong conceptual
dimension.
