IFC_mail: Re: federal register notice - FERC financial assurance rules

I've heard back from a few states interested in submitting comments and having 
a discussion.  Anyone interested in discussing in more depth, please fill out 
the doodle

 I've scheduled most options for the midday to afternoon (eastern time) so 
western folks can join at a reasonable time.  Once we have a date I'll send out 
a Teams invitation.

Here are some thoughts to consider:


  *   So far there have only been several comments submitted to FERC.  See 
attachments.
  *   I suspect more comments from the hydro industry opposing the proposal.
  *   There needs to be a counterpoint from the environmental perspective, 
including:
     *   Environmental damage caused by dam failure that can be avoided and 
which falls in large part on the state to deal with.
     *   Environmental damage from projects not in compliance or out of 
commission, while everyone waits for the licensee to bring it into compliance 
or repair it.
  *   Once a license is surrendered, the project becomes less valuable. This is 
even more true for exemptions because they will most likely not be granted a 
new license or exemption.
  *   Once the project has no viability with FERC, it is easier to work on 
getting the dam removed and restoring the river.
  *   Of the roughly 40 FERC licenses and exemptions in NC, one was breached 
from a hurricane in 2016 (still not repaired due to dam safety and financial 
issues), and another has been out of service since 2008 (FERC still has not 
forced a license surrender).  There are a number of other run-of-river projects 
that are marginal and probably would be surrendered.

FERC just noticed this inquiry about possibly establishing rules requiring 
hydropower licensees to assure they have the financial resources to properly 
fulfill license requirements, repair damage (e.g., hurricanes) or 
decommissioning.  I know of a few hydro projects in NC that have been out of 
service or have been damaged and are sitting around for years.  It would be 
good to force them to make the repairs or surrender the license (or exemption) 
so that the dams could be removed.

You might consider commenting.  Share if you think this is worth discussing via 
a Teams call.
