It does have a question about case termination (which means it failed
collaboratively).  The question is in Section 2 and reads: 

 

OUTCOME OF THE CASE
  Collaborative process terminated prior to complete settlement
Completed case with Settlement Agreement       Reconciled      

If the process terminated and there was a partial Collaborative Settlement
Agreement, check here: 

If the case did not settle or result in reconciliation, it must have
terminated prior to complete settlement.  We are surveying right after the
case completes and we don't know whether it actually went to litigation or
not.   It may have terminated and then been dismissed, but for whatever
reason, a settlement was not reached.

Why doesn't the survey doesn't have a question to identify if the case
failed and went to litigation?
