I don't know where I found this draft agreement (it may well have been here
on the listserve!), but it has been edited to meet our needs in a
collaborative case in Rochester.  If the formatting gets screwed up in the
translation, please let me know and I can figure out how to post this as a
document or e-mail it to you off-group.

CONSULTING EXPERT'S PARTICIPATION AGREEMENT

____________________ [Name of Wife] and her attorney _____________ [Name],
____________________ [Name of Husband] and his attorney _______________
[Name], and _____________________ [Name of Expert] enter into this
Consulting Expert's Participation Agreement.  The Husband and Wife
(hereinafter "the parties") have chosen to use the principles of
Collaborative Law to settle the issues of their divorce.  The parties have
agreed that, when appropriate, they will use neutral experts for any issue
which requires expert advice and/or recommendations.

The parties have agreed to retain ____________________ [Name of Expert] as
consulting [appraiser/accountant/ psychologist/financial expert/other] for
the purpose of ___________________________________________________________

______________________________________ [state in detail the expert's
duties].  The parties agree to pay the aforesaid consulting expert a
retainer of $ __________

The parties and the consulting expert agree that, if this matter becomes
adversarial, said consulting expert may not be called as a witness or
introduce his/her work product except by the mutual agreement of the parties
in writing.

information requested by the Consulting Expert and sign all necessary and
reasonable authorizations requested by said expert.

Bradley, I am on the drafting committee of the Collaborative Law Institute
and we are going to draft a sample uniform contract for y'all to use, but
one has not been drawn to date.  I know that Patrick Savage has a form he
uses, so you might want to contact him.  Just as soon as we've drafted one
for uniform use I'll email it to you, Janet
