Here are my responses:
· Does your state have medical amnesty? Kansas has Lifeline 911 Law
(link to the short legislation:
http://www.kslegislature.org/li/b2015_16/measures/documents/summary_sb_133_2016.pdf).
· Are medical amnesty cases handled in any special way? We currently
have amnesty on our cases solely for alcohol and it only is applied for the
person that makes the call/seeks assistance. They would receive a traditional
referral to our office, but we would note in our referral summary that on face
value their behaviors could be considered as acting under the university’s
alcohol amnesty policy. We then meet with the student and let them know we are
finding them responsible. The meetings focus on the pro-social behaviors they
engaged in. We will talk about their alcohol usage and offer to refer them to
resources if they would like, but do not mandate it.
* Do these cases result in a student disciplinary record? Yes, but as a not
responsible finding which we do not report for background checks.
* Are this cases managed by student conduct professionals on campus or
elsewhere? All Amnesty cases must meet with me.
* Do you have special letter templates that you use for medical amnesty
cases if you do not charge them under your code of conduct? Not as of yet.
* Please share another other relevant information related to medical
amnesty. Currently I am working with Student for a Sensible Drug Policy on a
revision of our amnesty policy. Specifically, we would like to include all
substances, not just drugs and make it “double amnesty” in which the student
that seeks help and the student that receives medical aid would not have a
conduct record. The person that receives the aid would then meet with me where
we would have them complete certain educational programs that would be
considered a deferral of conduct action as long as they are completed. If they
fail to do so, or don’t meet with me, we will pursue our traditional conduct
process.

During the 2011 Texas Legislative Session, a new law was passed commonly
referred to as the 911 Lifeline Law. This law states that "there is no penalty
for consumption or possession of alcohol by a minor if the minor was the first
person to request emergency medical assistance in response to the possible
alcohol overdose of the minor or another person, and remained on the scene
until the medical assistance arrived, and cooperated with medical assistance
and law enforcement personnel."[Alcoholic Beverage Code §§ 106.04, 106.05]
Is this similar to what you are asking about?

Hello Fellow Big 12 Colleagues,
I am excited that each of you have decided to join our listserv. Here in West
Virginia, medical amnesty legislation was passed this past year. I have formed
a working group here on campus to review how we are employing medical amnesty.
Once this passed, prior to my arrival on campus, the Office of General Counsel
added language regarding medical amnesty to our code of conduct. I am planning
to make some tweaks to this but prior to making these changes, I would
appreciate any insights that you might offer.
Can you please share the following:
* Does your state have medical amnesty?
