The Consumer Product Safety Improvement Act of 2008 - Public Law 110 spells out 
in very convoluted forms that if you sell anything that can reasonably be 
expected to be used by a child under the age of 12, it must be third party 
tested and certified. Lawyers are already disagreeing about who is responsible. 
Most I've read seem to understand the law to say that if you buy a product 
(imported or US made) wholesale and change it in any way (embellish it), then 
you must get your products third party tested. Some interpret the law in 
various other ways. My point is, that as long as the lawyers can't agree as to 
who is effected, you place yourself right smack in the path of a law suit 
untill it's settled by the courts. The consignment/resale shops have been very 
busy getting legislation to exempt them and they got it, but only after a lot 
of folks contacted their congressmen. The craft business folks are busy trying 
to get the law to exempt them. No luck so far. By the way, the law
  says that any inventory that is not certified becomes toxic waste and cannot 
be sold. There are small designers giving blow-out deals on their childrens' 
clothing to get it out the door before Feb 10. The embroidery professionals 
have been very quiet about this, thinking it won't effect us, I guess. I just 
can't afford to take the chance of a law suit. I don't want to be anyone's test 
case. There are plenty of folks out there who wouldn't hesitate to turn their 
competition in for selling without the expense of the certification in unfair 
trade practices. Just check out the law for yourself and see what you think.
