Authority to try would be vain and idle, without an authority to redress;
and the sentence of a court would be contemptible, unless that court had
power to command the execution of it; but who, says Finch, shall command

DENT, P. (Supreme Court of Appeals of West Virginia): The word "state" is
generally used to denote three different things, and often without
discrimination: First, the territory within its jurisdiction; second, the
government or governmental agencies appointed to carry out the will of the
people; and, third, the people in their sovereign capacity. The state is
not the sovereign in this country. The people who make it are sovereign,
