9Bonanza and all westerns give us a glimpse of truth. Movies I think are quite
revealing. My favorites Are Tom Horn, Johnson Country war, Billy the kid. In
Billy the kid the cattle barons were fighting and the military called them
before the captain. The killing must stop. Captain questioned what was going on
and told them to settle the matter or he would bring both of them before the
tribunal with them in jail till settled. Today sheriff's should be settling
this. Tom Horn as a regulator. They hired the best gun to enforce the law of
theft. That was the law until someone called the U.S Marshall or a judge to
settle the matter. Then a jury was held. That jury was more like today. Being
in the very late 1800's it would seem true. Johnson war was fought out like
McCoys. But ended with the community calling for a trial against the cattle
baron, hands and investors on trial. The community deciding.

Hi Paul,
The crimjnsl trials I have watched on Bonanza and other Westerns since
recently learning about territorial jurisdiction actually fit fairly well and
could be legitimately how criminal trials transpired in the Nevada Territory
before the Civil War.
They appear to function like common law is supposed to work, not like the
territorial jurisdiction courts and Municipal jurisdiction courts I have been
in.

Dice to your question/s
Common law court has certain distinctions. It has no written law. The law is
written on the heart/conscience or by charter/agreement. Second it requires
an injury, Third is a jury who determines the facts and law, ultimately.
There are other distinctions but those are the main ones. When dealing with
government one should never have go to jury because the fiction cannot ever
enter the court. Just like a judge will tell you that if your not the
fiction. Then you did not appear and then charge you. One must prove
jurisdiction of the fiction or man. Fiction does it by assumptions and
presumptions. You came to court so you must be the fiction. You did not reply
so they assume fiction is running and arrest you.
Man does it by facts and reason to send a notice and demand. Classifying your
position to the court.
Common law is about contract law and your conscience/natural law. Many here
say they never signed the contract. I see it as nonsense. My dad signed
contracts that I was liable for. In fact my great uncles and grandfather did
also. When one comes to this country. It is imperative when naturalized to
agree to the constitution. Those that are illegal with just United States
citizenship have no constitutional protections. Which are huge. Most
Americans have to clue how to protect or activate them. Confused souls?
. The Bible is A written agreement and your liable wether you Signed it
or not. Think about it. The creator made the charter rules/agreement for its
creation. Our forefathers made an agreement when it created government. So
are you the creator or Creation of that agreement? If not then what are you?
One Might claim their creator of the Holy Bible as the demands of creator
that all have to honor as creation. The basis of your court. Be prepared to
convince the jury of the Holy Bible. That tells one of the God Who created
man. Or, versus some other document. Atheists have no law but the law of
their conscience. Which we know could be evil amongst men.
Your choice to decide if your one of the people that created this government
to honor the constitutional agreement. Or what document your going to use?

Charley,
When I watch an old Bonanza episode and there is a trial with a circuit
judge and a jury, is that a common law court even though is held in a U.S.
Territory with a federal flag hanging?
