Thanks Tony - that is the way I read it.

I consider it very worrying indeed that anybody can simply set up signal
control with little
or no expertise or knowledgeable input but it may well be that this is
something we must
live with.

It is the TMA and the notification requirements which has caused this to
raise its ugly head.

As "I" read Reg 53 says
(a) Permission is given in writing, or in the case of urgency, given orally
and confirmed in writing as soon as reasonably practicable thereafter ; AND
(b) EITHER-
(a) the written permission of the authority.etc ;or
(ii) the authority is satisfied  that the circumstances of the case fall
within one of the sets of circumstances specified in Para (2).

(2) The sets of circumstances referred to in Para (1)(b) are_

(a) Control by constable
(b) where the signals are placed on a length of road along which-
(i) There is no junction
(ii) The width is restricted

No setting aside the fact that you would be hard pushed to find any length
of road without a junction ;o} I believe that because 53 2 b refers BACK to
this regulation
Sooo... I would argue that they STILL require authorisation.

Either way they still require authorisation at permanent signals.

Anyway doesn't our obligation under TMA supersede this??

That'll be £300 pounds!

Portable Signals - Authorisation

Following the advice in TSRGD Regulation 35, our understanding is that all
portable signals (not just those at or near a junction) used on the public
highway must benefit from written authorisation by the Highway Authority.

This is being questioned by many utility companies in our area, citing
paragraph 53 (2) b, and I would ask for your opinions and what policies you
adopt in your respective authorities.
