Dave
We have only gone to tender once with MF/1, and did struggle with =
suitable
percentages. I agree with Peter's statement about the figures standing =
up
in law.

We used the following on a contract value of approx =A3100,000:

SUB-CLAUSE 34.1
Percentage of Contract Value to be paid
or deducted for each week of delay. 1%

Maximum percentage of Contract Value
which payments or deductions shall
not exceed. 10%

I hope this helps.
Regards
Keith

Subject: [TCUG] MF/1 Contract - Liquidated Damages

I am trying to gather some information on what value other authorities
define within their contracts for the following Clause in MF/1 tenders
Clause 34.1

. Delay in Completion for Percentage of contract to be paid or
deducted for each week of delay %
=20
. Maximum percentage of contract vale which payments or deductions
shall not exceed %

. Maximum loss recoverable by the purchaser for prolonged delay %

Any feedback would be appreciated.

Dave
